Welcome to Chirpify! These Terms of Service ("Terms") govern your use of the Chirpify service ("Service") operated by Chirpify ("we," "us," or "our"). By accessing or using our Service, you agree to be bound by these Terms.

2. Description of Service

Chirpify is a cloud-based service that provides advanced filtering and processing capabilities for TradingView alerts. Our Service allows you to:

• Filter TradingView alerts using complex logic (AND/OR/NOT operations)
• Process alerts from private indicators without requiring source code access
• Deliver filtered alerts through multiple channels (Telegram, webhooks, email)
• Manage alert frequency and timing
• Correlate alerts across multiple indicators and timeframes

3. User Accounts and Registration

3.1 Account Creation

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the security of your account credentials
• You must be at least 18 years old to use our Service
• One person or entity may not maintain multiple free accounts

3.2 Account Responsibility

• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account
• We reserve the right to suspend or terminate accounts that violate these Terms

4. Acceptable Use

4.1 Permitted Uses

You may use our Service for legitimate trading and investment purposes, including:

• Filtering and processing your own TradingView alerts
• Automating your personal trading workflow
• Managing alerts for indicators you have licensed or own

4.2 Prohibited Uses

You may not use our Service to:

• Violate any applicable laws or regulations
• Process alerts from indicators you do not have legitimate access to
• Share or redistribute filtered alerts without proper authorization
• Attempt to reverse engineer, hack, or compromise our systems
• Use automated systems to create accounts or abuse our Service
• Resell or redistribute our Service without written permission
• Use our Service for high-frequency trading that could impact system performance
• Violate TradingView's terms of service or any third-party platform we integrate with

5. Service Plans and Billing

5.1 Plan Types

• Free Plan: Limited alert processing with basic features
• Paid Plans: Enhanced features, higher limits, and priority support

5.2 Billing Terms

• Paid plans are billed monthly or annually in advance
• All fees are non-refundable except as required by law
• We reserve the right to change pricing with 30 days' notice
• Failed payments may result in service suspension
• Taxes are your responsibility where applicable

5.3 Free Trial and Cancellation

• We may offer free trials for paid plans
• You can cancel your subscription at any time
• Cancellation takes effect at the end of the current billing period
• You retain access to your data for 30 days after cancellation

6. Data and Privacy

6.1 Your Data

• You retain ownership of your trading data and alert configurations
• We process your data solely to provide our Service
• You can export your data at any time
• We implement industry-standard security measures to protect your data

6.2 Data Usage

• We may use aggregated, anonymized data to improve our Service
• We do not sell or share your personal trading data with third parties

7. Service Availability and Performance

7.1 Service Uptime

• We strive for 99.9% uptime but cannot guarantee uninterrupted service
• Scheduled maintenance will be announced in advance when possible
• We are not liable for losses due to service interruptions

• Alert processing times may vary based on system load
• Rate limits apply to prevent system abuse
• We may throttle or suspend accounts that exceed reasonable usage

8. Intellectual Property

• We own all rights to our Service, software, and documentation
• You receive a limited license to use our Service under these Terms
• Our trademarks and logos are our exclusive property

• You retain ownership of your original content and data
• You grant us permission to process your data to provide our Service
• You must respect third-party intellectual property rights

9. Third-Party Integrations

Our Service integrates with third-party platforms including TradingView, Telegram, and others. You must:

• Comply with all third-party terms of service
• Maintain valid accounts with integrated services
• Understand that we are not responsible for third-party service changes or outages
• Notify us if you lose access to integrated accounts

• Our liability is limited to the amount you paid for our Service in the past 12 months
• We are not liable for consequential, indirect, or incidental damages
• This includes trading losses, missed opportunities, or data loss
• Some jurisdictions may not allow these limitations

11. Indemnification

You agree to indemnify and hold harmless Chirpify from any claims, damages, or expenses arising from:

• Your use of our Service
• Your violation of these Terms
• Your violation of third-party rights
• Your trading activities and decisions

12. Termination

12.1 Termination by You

• You may terminate your account at any time
• Termination does not entitle you to refunds
• You remain responsible for charges incurred before termination

12.2 Termination by Us

We may suspend or terminate your account if you:

• Violate these Terms or our policies
• Fail to pay required fees
• Use our Service in a way that harms our systems or other users
• Engage in fraudulent or illegal activities

12.3 Effect of Termination

• Your access to our Service will be revoked immediately
• We will provide reasonable opportunity to export your data
• Certain provisions of these Terms survive termination

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by:

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Chirpify regarding our Service.
